Intellectual properties department heading to solve intellectual copyrights problems

At Hua Hin Grand Hotel, Prachuap Khirikhan Province, Mrs. Phuangratana Ashvabishidh, Director General of Department of Intellectual Properties, revealed that the Department itself has been established since 2002 and is still recognized very little. There are currently more and more accusations to the courts in terms of copyright violation, and the Department takes an important role to reconcile disputes so that the problems will not be continued to the court process, especially the violations on the copyrights of OTOP goods, products derived from local wisdom, imitated foreign goods, and so forth.

In Thailand, the problem of intellectual copyright violation which is often found is one with both Thai and international CDs which have been illegally copied and contributed. By this, referring to dramatic records, the Department, coordinating with the police, has been continuously examining and quashing the action. Our country has not been pressured by the authority of the United States, but serious quashing has been conducted to take care of Thais whose goods have been unfairly violated. It is noted that, particularly, software copyright violation exists so much that the Department has to be responsible to solve the trouble.

“Today, I believe Thais own such brilliant intellectual creativity to design and create a great number of useful items, especially those concerning software.  Unfortunately, they have been evily imitated, and this has made the real owners so disappointed that they haven’t any motivation to continue their creativity, and will eventually quit their occupations. The copyright violation, therefore, causes the severe destruction directly to all entrepreneurs,” Mrs. Ashvabishidh said. 

“In the case of Teng Terd Teung, comedian, he burst into tears when suddenly after his movie appeared in the cinema for just a few days, there were unexpectedly a lot of copied CDs sold everywhere on the corners of streets. This is the true damage occurring with the compatriots themselves. At worst, some entrepreneurs produce their own entertainment with low assets, and are then faced with such awesome situations, so they have neither moral support, nor stimulating forces to create brand new masterpieces.

In foreign countries, although a lot of their tasks have been violated, they have still survived. However, the theme of intellectual property copyright violation is considered very important to them. They, therefore, make pressure on our country to urge the quashing of this illegal action. Anyway, there is a doubt that reporters presented news and handed it into the headquarters of newspapers, and through radio and television broadcasting, whether the action is considered as illegal copyright violation. The answer is that it is just the memorization of news to be propagandized through the press and the advantages subsequently become mutual and public. Nonetheless, if any reporter would like to take action for the signing of intellectual copyright, he or she will conduct that in writing forms of articles, or official literature, and the name of that reporter should be noted. Eventually, the procedure should be formally informed to the Department, and kept in the system without any copyright signing.

If more than 10-20 pages of his or her articles and literatures are propagandized without admission, action will be automatically taken for the violation and can be brought into the court procedure,” adds Director General of the Department of Intellectual Properties.
